Hazmat OT Rule Doesn't Apply To Ecolab Exterminators: Judge

Law360, New York (January 24, 2013, 2:22 PM EST) -- A California federal judge ruled Wednesday that Ecolab Inc. improperly denied overtime to hundreds of exterminators, striking down the sanitation giant's defense that the workers were exempt from overtime pay because they handled hazardous materials.

U.S. District Judge Gary A. Feess said the exemption — designed to prevent hazmat truck drivers from driving for long, potentially dangerous shifts — didn't apply to workers who incidentally carry small quantities of chemicals as part of their jobs.
