Appeals Court Vacates Summary Judgment Favoring Disney in Patent Dispute

Law360 (October 13, 2003, 12:00 AM EDT) -- The Federal Circuit of the U.S. Appeals Court vacated a lower-court summary judgment ruling that an enhanced TV system used by Disney, ABC and ESPN in broadcasts including "Monday Night Football" didn't infringe on patents owned by ACTV, the company said in a statement.

The Federal Circuit ordered the U.S. District Court in New York to consider ACTV's claims of both literal infringement and infringement under the doctrine of equivalents.
