The State Of Indemnity In Calif.

Law360, New York (January 30, 2013, 6:11 PM EST) -- Much has been said recently about the trend in California — as has been said in states like Oregon and Washington — of ending indemnity for the negligence in construction defect cases. In 2009, revisions to California's indemnity statute invalidated any residential construction contract provision requiring a subcontractor to indemnify a builder for the builder's negligence in construction defect claims. This year, California extends its “anti-indemnity” legislation to all other private nonresidential contracts and public contracts.
