Halliburton Benefits Suit Revived By 2nd Circ.

Law360, New York (January 29, 2013, 6:47 PM EST) -- The Second Circuit on Tuesday reopened a putative class action that alleges Halliburton Co. improperly cut retirement benefits for workers at a former subsidiary, authoring a decision that makes new law on when retirement plan members have the right to sue.

Halliburton cannot avoid a lawsuit by claiming that an employee should have tried harder to work within its “baffling” system for administering retirement plans, a panel of judges said in a written opinion.
