Pfizer Ducks False Ad Suit Over Immune Supplement

Law360, Los Angeles (January 31, 2013, 5:42 PM EST) -- A California federal judge on Thursday threw out a putative class action against Pfizer Inc. by a woman accusing the company of falsely advertising an immune function supplement called Pro Nutrients Probiotic, saying the plaintiff failed to show evidence that the product is ineffective.

Consumer Joann Arroyo’s July complaint alleged that Pfizer had violated California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act because its nutritional supplement, according to her own experience, didn’t support healthy immune function as advertised.
