Statutory Duties Do Not End With Workers' Comp

Law360 (November 29, 2007, 12:00 AM EST) -- Workplace injuries impose various obligations on employers, one of the most obvious of which is to treat and possibly compensate injured employees through the workers’ compensation system.

Many employers make the mistake of believing that the workers’ compensation process satisfies all of the employer’s statutory imposed duties to the injured worker. It may not.

When an employee is injured, employers generally provide the injured employee with a workers’ compensation claim form and then submit the claim to their insurance carrier.
