CVS Workers Granted Class Cert. In FLSA Overtime Suit

Law360, New York (February 6, 2013, 2:23 PM EST) -- A group of CVS Pharmacy Inc. loss-prevention managers who allege the company denied them overtime pay have met the burden to pursue their claims as a class, a Georgia federal judge ruled Monday.

U.S. District Judge Thomas W. Thrash Jr. granted a conditional class certification motion filed by named plaintiff Philip Bradford, who previously worked for CVS as a regional loss-prevention manager, or RLPM, and says he was misclassified as exempt from overtime under the Fair Labor Standards Act.
