Rolls-Royce Whistleblower Loses Bid To Revive FCA Suit

Law360, New York (February 6, 2013, 4:08 PM EST) -- An Indiana federal judge on Monday declined to reconsider her dismissal of a False Claims Act suit brought by a former Rolls-Royce Corp. engineer alleging the company sold defective aircraft engine parts to the federal government, saying the plaintiff had simply rehashed previously rejected arguments.

U.S. District Judge Sarah Evans Barker granted summary judgment to Rolls-Royce in the qui tam action in September, finding that whistleblower Curtis Lusby was unable to single out individual parts and transactions involving nonconforming goods that were sold to the government....
