Pa. Gaming Board Immune From Licensing Suits: 3rd Circ.

Law360, New York (February 8, 2013, 7:48 PM EST) -- The Third Circuit on Thursday reaffirmed that the Pennsylvania Gaming Control Board is immune from lawsuits concerning licensing disputes, backing a lower court decision that tossed all federal claims against the PCGB commissioners in litigation surrounding the Presque Isle Downs casino.

A three-judge panel held that the PCGB commissioners, in issuing and denying licenses, occupy roles that are “functionally comparable to that of a judge” and enjoy a “quasi-judicial immunity” that blocked litigation from a gaming executive and real estate developer who claimed the PCGB retaliated...
