9th Circ. Reinstates Kaplan FCA Suit Over Fake Enrollments

Law360, New York (February 14, 2013, 2:48 PM EST) -- The Ninth Circuit on Wednesday partially reversed the dismissal of a False Claims Act suit accusing Kaplan Inc. of submitting fake student enrollment claims to the U.S. Department of Education, saying a lower court erred in requiring the plaintiff, a former Kaplan employee, to identify specific false claims before allowing the case to proceed.
