HHS Can't Shake FOIA Suit Over Formaldehyde Research

Law360, New York (February 14, 2013, 1:38 PM EST) -- A Washington federal judge on Wednesday denied the U.S. Department of Health Human Services' bid to dismiss a suit seeking documents related to a study which led the agency to list formaldehyde as a carcinogen, saying it hadn't shown it had conducted a thorough search of its records.

According to U.S. District Judge James E. Boasberg, industry group American Chemistry Council Inc. had reasonably claimed that HHS hadn't properly searched its records for all relevant documents related to the formaldehyde study under  a Freedom of Information...
