Insurer Says $650M TCPA Coverage Row Belongs In Ill.

Law360, New York (February 14, 2013, 10:53 PM EST) -- Indiana Insurance Co. on Thursday said its bid to avoid coverage of a potential $650 million Telephone Consumer Protection Act class action should stay in Illinois federal court, and called CE Design Ltd.’s efforts to move the case “forum shopping.”

The insurer is making another attempt to escape coverage of litigation accusing the now-defunct Matrix LS Inc. of sending unsolicited junk faxes to a certified class of as many as 1.3 million members, after the insurer's previous case was dismissed for failure to prosecute.
