Justices Scrap Insurer's ERISA Funds Recovery Appeal

Law360, New York (February 19, 2013, 4:26 PM EST) -- The U.S. Supreme Court on Tuesday declined to hear First Unum Life Insurance Co.'s appeal of a Ninth Circuit ruling that blocked the insurer's recovery of overpaid disability benefits, a decision First Unum claims will wreak havoc on the employment insurance system.

The high court rejected First Unum's October petition contending that the Ninth Circuit erred when it overturned an Arizona federal court's ruling and, in doing so, prevented the insurer from recovering funds paid out under an Employee Retirement Income Security Act plan that overlapped...
