Powerful NY Teachers Union Calls Tax Cap Unconstitutional

Law360, New York (February 20, 2013, 2:10 PM EST) -- New York's massive teachers union sued the state Wednesday, claiming a state cap on property tax increases marks an unconstitutional burden on poor and minority schoolchildren and seeking a court order nullifying the landmark 2011 law.

The 600,000-member New York State United Teachers filed suit in Albany County, saying the apparent purpose and practical effect of the tax cap is to limit the ability of school boards and school district voters to increase school funding beyond that permitted under the tax cap.
