Wal-Mart Beats Ex-Dukes Members' Bias Class Claims

Law360, New York (February 20, 2013, 4:27 PM EST) -- A Tennessee federal judge on Wednesday nixed as time-barred regional class claims lodged in October by a trio of women whose workplace discrimination allegations were previously raised in Dukes v. Wal-Mart Stores Inc.

U.S. District Judge Aleta A. Trauger concluded that Sixth Circuit precedent compelled the dismissal of the class claims in the Tennessee suit as time-barred, but also suggested that the precedent in question might be due for reconsideration, or at least refinement, to permit follow-on subclass actions to proceed under appropriate circumstances.
