Delphi Employees Seek To File Suit Over Hourly Pay

Law360, New York (December 7, 2007, 12:00 AM EST) -- Three Delphi Corp. employees have asked the judge overseeing the bankrupt auto parts maker’s Chapter 11 proceedings to lift the automatic stay so they can file an ERISA suit against the company and its pension plan in district court.

The employees filed their motion to vacate the stay Thursday in the U.S. Bankruptcy Court for the Southern District of New York, seeking permission to file an injunctive action against Delphi in Alabama district court.
