Fastenal Managers' Cert. Bid Falls Short In OT Pay Case

Law360, New York (February 27, 2013, 4:51 PM EST) -- A California federal judge on Monday decertified a collective wage-and-hour action brought by current and former general managers of industrial supply chain Fastenal Co., finding the individual plaintiffs' work experiences vary too much for a collective action to proceed.

U.S. District Judge Yvonne Gonzalez Rogers found that the facts surrounding the amount of time spent by the managers on exempt activities such as administrative, outside sales and executive work vary so greatly “that a collective action is unwieldy and unwarranted.”
