Herrick Feinstein Must Face Claims Over Bad Zoning Advice

Law360, New York (February 27, 2013, 1:40 PM EST) -- A New York state appeals court refused Tuesday to toss a suit against Herrick Feinstein LLP over allegedly bad zoning advice for an apartment tower project, saying evidence merited further litigation into whether it — rather than a deadly crane collapse or tanking economy — caused a lender's loss.

Backing up a lower court's decision, a First Judicial Department panel kept alive the suit by real estate investment trust Arbor Realty Funding LLC, which provided $70 million in bridge financing for a developer's proposed 43-story luxury...
