Blast Fax Class Wrongly Decertified, NJ Appeals Court Says

Law360, New York (February 28, 2013, 4:45 PM EST) -- A New Jersey appeals court on Thursday reversed class decertification in a suit over unsolicited fax ads sent by a policyholder of Farmers Insurance Co. of Flemington, saying the lower court did not articulate the reasoning for the decision.

A panel for the Appellate Division of New Jersey Superior Court remanded the class action back to the lower court, saying the trial judge did a “disservice” to the parties by failing to explain his rationale in granting Farmers' declaratory judgment to dismiss the action against one...
