Citi Wins Arbitration Of Debt Collection TCPA Suit

Law360, New York (March 4, 2013, 7:26 PM EST) -- A California federal judge on Friday granted a bid by Citi Holdings Inc. to compel arbitration in a putative class action brought by a trio of plaintiffs who allege the bank violated the Telephone Consumer Protection Act through excessive cellphone debt collection calls.

U.S. District Judge Michael M. Anello determined that each of the named plaintiffs entered into contracts with arbitration provisions that are are valid and rejected their arguments that the provisions should be tossed out because various clauses would prevent them from seeking recourse...
