AstraZeneca Escapes $100M AWP Suit Over Nexium

Law360, Los Angeles (March 5, 2013, 7:38 PM EST) -- A New Hampshire federal judge on Tuesday dismissed a $100 million average wholesale price False Claims Act suit against AstraZeneca LP over an alleged failure to provide truthful price information for its drug Nexium, after the U.S. declined to intervene.

Tuesday’s dismissal of the 2010 action comes just three months after the U.S. filed its notice of election to decline to intervene in November, opening up the action to be unsealed a month later. The suit, brought by qui tam relator Ven-A-Care of the Florida Keys Inc....
