Bra Retailers' Case Sags Amid Judge's Ruling

Law360 (December 12, 2007, 12:00 AM EST) -- In a blow to Victoria's Secret and other lingerie retailers, a Texas judge has given a lift to the other side in a battle over a nipple-obscuring prosthesis, choosing to adopt most of the language the plaintiff used to describe a key patent term.

On Tuesday, U.S. Magistrate Judge John Love issued a favorable claim construction to Randi Black, siding with her on nearly all of the disputed elements surrounding the definition of the so-called nipple cover.
