Diagnostic Co. Can't Punt Kickback, FCA Claims, Feds Say

Law360, Washington (March 12, 2013, 2:10 PM EDT) -- The U.S. government on Friday blasted Kan-Di-Ki LLC's attempts to toss a False Claims Act suit against it in California federal court, saying the diagnostic services provider misconstrued the whistleblowers' requirements to prove underlying criminal Anti-Kickback Statute violations in the case.

Kan-Di-Ki told the court that its former employees-turned-whistleblowers couldn't show the company specifically intended to defraud the government with its Medicare and Medi-Cal billings, nor could they prove the alleged criminal violations beyond a reasonable doubt, which would nix the FCA case.
