ALJ Dismisses FTC Claims Over Real Estate Listings

Law360, New York (December 13, 2007, 12:00 AM EST) -- In a blow to the Federal Trade Commission, an administrative law judge has dismissed claims that a Michigan realtors' group gave preferential listing treatment to property owners who offered commissions for the sale of their properties.

Chief Administrative Law Judge Stephen J. McGuire ruled that the FTC failed to prove that Realcomp II Ltd.'s policy - which limited Web site listings for property owners who did not use brokers as exclusive sales agents – violated Section 5 of the FTC Act, according to a decision announced...
