Philly Sheriff Ducks Class Cert. In $54M Property Auction Suit

Law360, Philadelphia (March 12, 2013, 5:40 PM EDT) -- A Pennsylvania judge on Tuesday refused to certify a class of plaintiffs alleging the Philadelphia Sheriff’s Office owes them as much as $54 million in excess proceeds from property auctions, ruling that state law already provided them with a means of collecting.

Judge Gary Glazer said that Pennsylvania rules of civil procedure and the state’s Disposition of Abandoned and Unclaimed Property Act allowed for the collection of excess proceeds — which the plaintiffs say they’re owed after their properties were auctioned off to satisfy tax liens...
