AEX Gets Driver Class Decertified In OT Suit

Law360, New York (March 15, 2013, 4:29 PM EDT) -- A Pennsylvania federal judge on Thursday decertified a class of delivery drivers who claimed American Eagle Express Inc. improperly denied them overtime pay, ruling the courier's lack of control over the drivers made their claims too varied for collective status.

U.S. District Judge Juan R. Sanchez concluded that although the drivers all performed similar work under the same transportation brokerage agreement, AEX's actual implementation of the contract varied so much from driver to driver that collective certification would have been inappropriate.
