Engle Ruling Leaves Tobacco Cos. With Dwindling Options

Law360, New York (March 15, 2013, 7:31 PM EDT) -- With the Florida Supreme Court's Thursday refusal to revisit its Engle ruling, attorneys say tobacco companies are running out of ways to dismantle the massive litigation in one fell swoop, putting them at risk of having to fight off thousands of suits one by one.

In its ruling, the high court said the application of one jury's liability findings against Philip Morris USA Inc. and other tobacco makers to up to 700,000 Engle progeny cases, which Engle allowed, does not violate the companies' due process rights...
