NRDC Can Sue Over Antibacterial Soap Regulation: 2nd Circ.

Law360, New York (March 15, 2013, 4:29 PM EDT) -- The Second Circuit found Friday that the Natural Resources Defense Council could sue the federal government for allegedly failing to regulate a potentially dangerous substance contained in antibacterial soap, overturning a lower court's ruling.

The NRDC sued the U.S. Food and Drug Administration in 2010 alleging consumers were at risk of health problems from triclosan and triclocarban, two common ingredients in antibacterial soap, but a New York federal court decided in 2011 that the council lacked standing because its members could avoid their workplace exposure to...
