9th Circ. Ruling Brings Consensus On DMCA Safe Harbor

Law360, New York (March 15, 2013, 8:14 PM EDT) -- A recent Ninth Circuit decision brings two major appeals courts into close alignment on how the Digital Millennium Copyright Act safe harbor should be interpreted, providing useful guidance on when online content providers can take advantage of the protections, attorneys say.

The Ninth Circuit held Thursday that video-sharing site Veoh is entitled to the safe harbor because it did not have knowledge of allegedly infringing content, applying the same legal standard the Second Circuit used last year in a case involving YouTube LLC.
