DISH Network Can't Hang Up On Unsolicited Phone Call Suit

Law360, New York (March 20, 2013, 4:06 PM EDT) -- A Colorado federal judge on Tuesday refused to dismiss a proposed class action against DISH Network LLC filed by a noncustomer accusing the company of making payment-reminder phone calls to him, saying the claims were not time-barred.

U.S. Senior Judge Wiley Y. Daniel decided the allegations were subject to the longer, four-year federal statute of limitations included in the Telephone Consumer Protection Act rather than the one-year limit set by Colorado state law.
