Hotel Franchisor Owed Death Suit Coverage, 11th Circ. Says

Law360, New York (March 25, 2013, 4:57 PM EDT) -- Westport Insurance Corp. must cover VN Hotel Group LLC and its franchisor Choice Hotels International in litigation over a man who died from Legionnaires' disease he allegedly contracted while staying at a Florida hotel, the Eleventh Circuit said Friday in an opinion clarifying an October ruling.

While its earlier decision had only made it clear that Westport was on the hook to VN Hotel, who owned the Quality Suites in Orlando, Fla., where the outbreak occurred, a three-judge Eleventh Circuit panel said in its revised opinion...
