Judge Won't Toss State Claims Against Roche

Law360 (December 19, 2007, 12:00 AM EST) -- A federal judge in New Jersey has denied Hoffman La-Roche's bid to have the state law claims in a putative collective action dismissed, rebuffing the defendants' claim that FLSA opt-in collective action and a state-law wage-and-hour opt-out class action are inherently incompatible.

In his Dec. 14 ruling, U.S. District Judge Jose Linares also granted the defendants' unopposed request to strike references to the defendants' alleged record keeping violations under the FLSA, and to strike the plaintiffs' request for penalties under the New Jersey state wage-and-hour law....
