VA Can't Dodge DaVita's Dialysis Contract Suit

Law360, New York (March 29, 2013, 3:07 PM EDT) -- A U.S. Court of Federal Claims judge on Thursday refused to dismiss a DaVita Inc. suit accusing the U.S. Department of Veterans Affairs of underpaying it for dialysis services, ruling the court has jurisdiction to hear the dispute.

Judge Mary Ellen Coster Williams found that the court has jurisdiction over the dialysis clinic chain’s claims that it had been underpaid for dialysis services, based on statutorily mandated rates and the specific terms of a 2009 contract, despite VA’s claims to the contrary.
