US Airways Freed From Skycaps' Suit Over Lost Tips

Law360, New York (April 2, 2013, 1:33 PM EDT) -- U.S. Airways on Friday escaped a putative wage-and-hour class action brought by skycaps accusing the airline and others of driving down wages by imposing a mandatory $2 per bag fee on travelers, after an Arizona federal judge concluded the airline was not a joint employer of the skycaps.

U.S. District Judge David K. Duncan ruled that U.S. Airways' relationship with the skycaps is more consistent with an outsourcing contract rather than a scheme to circumvent wage-and-hour laws, and granted the carrier's motion for summary judgment....
