NJ Architecture Firm Can't Escape Cost Overrun Suit

Law360, New York (April 2, 2013, 5:00 PM EDT) -- A New Jersey architecture firm must remain in a cost overrun suit filed against the Atlantic City Housing Authority after a federal judge ruled Tuesday that the construction company that filed the suit can pursue breach of warranty claims against the firm and ACHA.

Architecture firm Lindemon Winckelmann Deupree Martin Russell & Associates PC argued that because it didn't have a direct contractual relationship with constructor SRC Construction Corp., and because SRC  was pursuing an action against ACHA, its lawsuit is barred under New Jersey law. But...
