Partial Deafness Not A Disability Under ADA, Judge Says

Law360, New York (April 3, 2013, 5:08 PM EDT) -- A Pennsylvania federal judge on Friday ruled that deafness in one ear does not constitute a disability under the Americans With Disabilities Act, ruling in favor of The Reading Eagle newspaper in a former copy editor's disability and gender bias suit.

U.S. District Judge Lawrence F. Stengel granted summary judgment to the newspaper's owner, nixing former employee Christine Mengel's claims that the company had decided to lay her off during a 2009 reduction in force because of her disability and her gender.
