6 More Cases Back DR Horton In NLRB Row, 5th Circ. Told

Law360, New York (April 4, 2013, 10:47 PM EDT) -- D.R. Horton told the Fifth Circuit on Thursday that six more courts have refused to follow the NLRB's ruling against the company that found employer-mandated arbitration agreements barring class actions run afoul of federal labor law. 

The homebuilder cited six new cases in which courts had rejected the board's ruling in a letter filed with the appeals court in the company's challenge to the NLRB's Jan. 2, 2012, decision that the company's mandatory arbitration agreement violated the National Labor Relations Act.
