Rare Job Tasks Can Be 'Essential' Under ADA, 8th Circ. Says

Law360, New York (April 5, 2013, 2:39 PM EDT) -- The Eighth Circuit has ruled that employers can deem a job task an “essential function” under the Americans with Disabilities Act even if it's rarely performed.

A three-judge panel said Wednesday frozen-food delivery company Schwan's Home Service Inc. didn't violate the anti-discrimination statute by terminating Jeff Knutson after an eye injury meant he could no longer drive a truck because doing so was essential to his job as a manager.
