Fujifilm Digital Camera Class Action Set To Continue

Law360, New York (January 3, 2008, 12:00 AM EST) -- A federal judge has denied a motion from Fujifilm USA Inc. to throw out a purported class action that alleges the company knowingly sold defective digital cameras, allowing the case to continue toward trial.

In an opinion entered Friday, Judge Joseph A. Greenaway Jr. of the U.S. District Court for the District of New Jersey ruled that the plaintiff, camera owner Jerilynn Payne, had met the pleading standard although her camera malfunctioned after her one-year written warranty from Fujifilm expired.
