Hartford Life Suit Not Preempted By ERISA: Judge

Law360, New York (January 8, 2008, 12:00 AM EST) -- A federal judge has removed a suit brought against the Hartford Life and Annuity Insurance Co. to state court, finding that the case’s claims were not preempted by ERISA as the insurance company had argued.

Judge A. Joe Fish of the U.S. District Court for the Northern District of Texas ruled Friday that the case rightfully belonged in state court, where plaintiff Jerry Cotner originally brought his suit against Hartford Life in Feb. 2007.
