Market Researcher Ruined Rival, $20M Antitrust Suit Says

Law360, Los Angeles (April 18, 2013, 11:18 PM EDT) -- Magazine market research firm GfK Mediamark Research and Intelligence stole Affinity LLC's confidential information about its competing product and used the data to drive Affinity out of business, according to a $20 million antitrust lawsuit filed Thursday in New York state court.

GfK maintained its monopoly in the magazine audience research industry by learning Affinity's trade secrets during acquisition negotiations, then breaking a nondisclosure agreement and exploiting the data to undercut Affinity in the marketplace, the suit alleges.
