FLSA Claims Push Highmark OT Suit Into Federal Court

Law360, New York (April 19, 2013, 5:33 PM EDT) -- Health insurer Highmark Inc. removed to Pennsylvania federal court on Thursday a proposed class action accusing it of refusing to pay overtime for various supervisory functions performed by mid-level employees in its call center units, following plaintiff's addition of Fair Labor Standards Act claims.

Jacqueline Rummel, a former supervisor in the customer service unit of the company’s health plan operations department, originally sued the insurer in Cambria County Court of Common Pleas in February, accusing it of violating the Pennsylvania Minimum Wage Act.
