9th Circ. Refuses To Rehear Juicy Juice Labeling Case

Law360, San Francisco (April 19, 2013, 7:36 PM EDT) -- A Ninth Circuit panel Thursday refused Nestle USA Inc's. petition to rehear its ruling in a class action over Juicy Juice health claims, which found the plaintiffs showed Nestle falsely advertised the effectiveness of its brain development-labeled juice products, but not those purporting immunity benefits.

Nestle argued that the panel had been wrong to consider the plaintiffs' claims that Nestle lacked scientific evidence to prove its brain development juice contained enough docosahexaenoic acid to benefit consumers because those claims had been dismissed and the plaintiffs had not...
