Sanofi Can't Duck Amphastar's FCA Suit Over Lovenox

Law360, Chicago (April 19, 2013, 10:37 PM EDT) -- A California federal judge on Friday denied Sanofi-Aventis SA's latest bid to toss rival Amphastar Pharmaceuticals Inc.'s False Claims Act suit alleging it fraudulently inflated the price of its Lovenox anti-coagulant drug.

U.S. District Judge Marvin J. Garbis found that allegations in Amphastar's amended complaint were "sufficient to present an adequately pleaded plausible claim that Sanofi submitted, and/or caused to be submitted, false claims to the United States in connection with the alleged scheme."
