Early Cert. OK'd In Suit Over DOMA Immigration Benefits Ban

Law360, New York (April 22, 2013, 3:54 PM EDT) -- A California federal judge on Friday granted preliminary certification in a class action challenging the preclusion of immigration benefits to binational couples in same-sex marriages called for under the Defense of Marriage Act.

The provisional class approved by U.S. District Judge Consuelo Marshall encompasses all members of same-sex marriages who are not recognized as spouses under federal law pursuant to DOMA's definition of marriage as between a a man and a woman and denied lawful status and related benefits under the Immigration and Nationality Act....
