'Desperate Housewives' Suit Survives, Gets New Trial Date

Law360, Los Angeles (April 22, 2013, 4:39 PM EDT) -- A California judge on Monday refused to toss actress Nicollette Sheridan's lawsuit accusing the producers of "Desperate Housewives" of illegally firing her for complaining that producer Marc Cherry struck her in the head, rejecting Touchstone Television Productions LLC's argument that she didn't exhaust her administrative remedies before suing the studio.

At a hearing, Los Angeles County Superior Court Judge Michael L. Stern also set a Dec. 2 trial date to have a jury determine whether Sheridan's firing was in violation of California Labor Code Section 6310,...
