Volvo Beats Class Cert. In Faulty Truck Engine Suit

Law360, New York (April 22, 2013, 6:59 PM EDT) -- A North Carolina federal judge on Monday refused to certify a class action accusing two Volvo Group units of concealing engine defects from consumers, saying the plaintiffs failed to address what state’s laws should apply to warranty claims.

U.S. District Judge Catherine C. Eagles said the plaintiffs have not set forth what laws they believe apply to state law-based breach of warranty claims, and absent that information, the court cannot determine whether the case will be resolved by answering the proposed common questions regarding alleged defects...
