Razed San Antonio Building's Owner Loses Award In 5th Circ.

Law360, New York (April 24, 2013, 1:39 PM EDT) -- The Fifth Circuit on Tuesday vacated an award for the owner of a building that the city of San Antonio razed without notice, ruling that a jury was wrongfully led to believe that demolition was only appropriate if there was an immediate public danger.

Remanding the case back to the district court, a three-judge panel ruled that questions posed to the jury improperly shifted the focus away from whether San Antonio reasonably acted in compliance with an ordinance that allowed it to conduct emergency demolition....
