SAFETY Act: A Cybersecurity Win-Win For Gov't, Industry

Law360, New York (April 24, 2013, 3:20 PM EDT) -- The U.S. Navy recently announced that it is hit with approximately 11,000 cyberattacks per hour. In September 2012, several of the largest U.S. banks were hit by a massive cyberattack, possibly launched by Izz ad-Din al-Qassam Cyber Fighters, self-proclaimed cyber-jihadists. In response to these types of threats, on Feb. 12, 2013, President Obama signed an executive order that aims to establish a voluntary program for the adoption of cybersecurity standards to protect critical infrastructure, as well as a public-private partnership for information sharing. In the meantime, what can industry, particularly owners of critical infrastructure (energy, banking, telecommunications and defense), do to minimize potential third-party liability arising from cyberattacks?...
