Kinetic Wants To DQ Whistleblowers' Attys Over Misused Docs

Law360, New York (May 1, 2013, 4:58 PM EDT) -- Medical device maker Kinetic Concepts Inc. on Monday urged a California federal judge to disqualify the attorneys for whistleblowers accusing the company of violating the False Claims Act by falsely billing Medicare, saying the relators’ counsel had misused KCI's privileged documents.

According to KCI reply brief — filed in response to relators' Steven Hartpence and Geraldine Godecke's opposition to KCI’s disqualification motion — the relators' counsel were aware that they were in possession of hundreds of privileged KCI documents and had failed to destroy or return the documents,...
